REGULATIONS OF THE "BLACK WEEK" PROMOTIONAL CAMPAIGN
§1 GENERAL PROVISIONS
- The promotion named "BLACK WEEK," hereinafter referred to as the Promotion, is organized within the territory of the Republic of Poland and is conducted by Fitness Authority Sp. z o.o. in Otomin.
- The organizer of the promotion and the founder of the prizes is Fitness Authority Sp. z o.o. with its registered office in Otomin (80-174) at ul. Konna 40 , entered into the register of entrepreneurs of the National Court Register (KRS) kept by the District Court Gdańsk-Północ in Gdańsk, VII Commercial Division of the KRS, under KRS number: 0000355208, NIP: 9571037001; REGON: 221006572.
- The Promotion is addressed to the clients of the online store.
- These Regulations govern the rules of organizing the Promotion.
§2 DURATION OF THE PROMOTION
- The Promotion begins on November 21, 2025, at 12:00 PM and will last until December 1, 2025, at 3:00 PM (the date and time of placing the order is decisive) or until stocks last.
§3 TERMS AND CONDITIONS OF THE PROMOTION
- The Promotion covers only selected products that have been explicitly marked with a discount notice in the Store.
- The discount does not apply to all products available in the Store's offer. Products not marked as covered by the promotion are sold under standard rules, without a discount being calculated.
- The Black Week Promotion cannot be combined with other promotions, discounts, or discount codes available in the store.
- The Promotion does not include proteins and gainers.
- The list of products covered by the promotion may change during the promotional campaign and is presented each time on the Store's website next to the appropriate products.
§4 COMPLAINTS
- Complaints regarding the course of the Promotion may be submitted via email to the store's contact email address.
- Complaints will be reviewed by the Commission within 14 (fourteen) days from the date of their receipt.
- The Commission will review the Promotion Participants' complaints based on the Regulations.
- The Commission's decision on the complaint is final. The Promotion Participant will be notified of the method of handling the complaint via an email sent to the email address from which the complaint was submitted.
§5 PERSONAL DATA PROTECTION
The Administrator of the Participants' personal data (hereinafter referred to as "Personal Data") is the Organizer, i.e., Fitness Authority Sp. z o.o. with its registered office in Otomin, ul. Konna 40. Personal Data will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter: GDPR). Detailed rules for the processing of Personal Data are presented below.
Personal Data will be processed by the Organizer with the Participant's consent for purposes related to the organization of the Promotional Campaign, including, among others, for the purpose of identifying winners and issuing prizes (legal basis: Article 6(1)(a) of the GDPR) , as well as for purposes related to the realization of the Organizer's legally justified interests, such as reviewing any Participant complaints and for evidentiary purposes for defense in matters concerning claims related to the Promotional Campaign (legal basis: Article 6(1)(f) of the GDPR) , and in the case of Winners, also for purposes related to the fulfillment of legal obligations resulting from tax and accounting regulations (legal basis: Article 6(1)(c) of the GDPR).
Authorized employees of the Organizer may have access to the Personal Data. Participants' Personal Data will generally be stored by the Organizer for the duration of the Promotional Campaign, and for about 6 weeks after its completion for purposes related to reviewing Participant complaints , with the reservation that in justified cases the data may be stored by the Organizer until the expiration of claims not taken into account in the complaint procedure or longer if it is necessary for defense in court proceedings concerning these claims.
Providing Personal Data and granting consent for their processing by the data subject is voluntary, but necessary to register participation in the Promotional Campaign.
The Participant may exercise the following rights towards the Organizer, in particular:
- The right to request access to their Personal Data and obtain information about their processing, and in case they are inaccurate, the right to request their rectification (in accordance with Articles 15 and 16 of the GDPR).
- The right to request the restriction of the processing of their data in the situations and under the rules indicated in Article 18 of the GDPR (the Participant may request the restriction of the processing of their personal data for the period of verifying their correctness or until their objection to the data processing is considered. This right also applies if, in the Participant's opinion, the processing of their data is unlawful, but they do not want the data to be deleted immediately, or if the data is needed longer than the assumed processing period, due to matters of establishing or defending claims).
- The right to withdraw previously granted consent to the processing of Personal Data, which, however, will not affect the legality of the processing of the Participant's data that was based on this premise and took place before the Participant exercised their right to withdraw consent.
- The right to request the deletion of data in accordance with Article 17 of the GDPR ("right to be forgotten").
- The right to data portability in accordance with Article 20 of the GDPR , i.e., to receive their personal data from the Organizer in a structured, commonly used, machine-readable format , and also to request their transmission to another data administrator. This right applies only to Personal Data provided to the Organizer by the Participant and having an electronic form.
- The right to object at any time to the processing of their Personal Data for reasons related to their particular situation, in the case where the data are processed by the Organizer as part of the realization of its legally justified interests (in accordance with Article 21(1) of the GDPR).
In matters related to the processing of Personal Data and the realization of the rights entitled to Participants, contact the Organizer by sending correspondence to the email address: ido@fitnessauthority.pl. The person who has submitted an application or request concerning the processing of their Personal Data, as part of exercising their rights, may be asked by the Organizer to answer several questions related to their Personal Data, which will enable the verification of their identity. Furthermore, the Participant has the right to lodge a complaint against the processing of their Personal Data by the Organizer to the President of the Personal Data Protection Office (address: ul. Stawki 2, 00-193 Warszawa).
§6 FINAL PROVISIONS
- These regulations enter into force on November 21, 2025.
- In matters not regulated by the Regulations, the provisions of the Civil Code shall apply.
- The Organizer reserves the right to introduce changes to these Regulations at any time without stating a reason. However, changes in the regulations cannot violate the rights acquired by the Promotion Participants.
- Any disputes between the Organizer of the Promotion and its Participants will be settled by the court competent for the Organizer's registered office.
- The promotional materials for the Promotion are for informational and promotional purposes only. Only the provisions of these Regulations have binding legal force
