Terms and conditions of the promotion (hereinafter referred to as the "Promotion")
"[Creatine Vertigo]" (hereinafter referred to as the "Terms and Conditions")

 

1. The Organizer of the Promotion is FITNESS AUTHORITY Spółka z ograniczoną odpowiedzialnością with its registered office in Otomin (80-174) at ul. Konna No. 40, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register under the KRS number: 0000355208, NIP: 9571037001, REGON: 221006572, share capital PLN 16,000,000.00 [hereinafter: the Organizer].

2. The Promotion is conducted in the territory of the Republic of Poland. The Promotion is held at the online store located at https://fasklep.pl/

3. The Promotion is called "Kreatinous Headache" (hereinafter referred to as the "Promotion") and is valid in the Brand's online store at https://fasklep.pl/ (hereinafter referred to as the "E-store").

4. The Promotion is not a game of chance within the meaning of the Gambling Act of 19 November 2009.

5. The Promotion does not constitute a public offer or promise within the meaning of the Civil Code.

6. Information about the Promotion is available on the E-Shop website.

7. The promotion applies to products available at https://fasklep.pl/ .

8. The promotion means that starting February 13, 2026, you will be able to purchase selected creatine products at a promotional price. Selected products marked with the promotion will have their prices reduced by 25%.

9. The Promotion cannot be combined with discounts offered through the Organizer's loyalty programs, nor with other price/discount promotions available in the Online Store during the Promotion period. If other promotions (including discounts) are in effect during the Promotion period, the Customer has the right to choose which promotion they wish to use.

10. The Promotion cannot be exchanged for cash or goods.

11. The Organizer is not responsible for any improper use of the Promotion.

12. The Promotion is intended for customers who are consumers within the meaning of the relevant provisions of the Civil Code and does not include wholesale sales. Only individuals with full legal capacity may participate in the Promotion.

13. The promotion does not include shipping costs.

14. The Customer's ability to take advantage of the Promotion is not limited in quantity.

15. The promotion runs from 13 February 2026 at 12:00 noon to 2 March at 12:00 noon.

16. The provisions of the Regulations do not conflict with the provisions of the Civil Code and the Consumer Rights Act and do not constitute an obstacle to the Customer exercising the rights provided for in the provisions of the Civil Code and the Consumer Rights Act or to the Customer pursuing claims under the aforementioned provisions, i.e., first of all, the Customer is entitled to file a complaint in relation to the purchased Products as well as to withdraw from the distance contract.

17. In the event of withdrawal from the sales contract, the Customer will be refunded the amount constituting the value paid by him, i.e. taking into account the discount granted under the Promotion.

18. Partial withdrawal by the Customer from the sales contract concluded as part of the Promotion may result in the loss of the granted discount. The provisions of point 18 do not apply to withdrawal from the sales contract based on the warranty for defects. The right to withdraw from the contract may be granted by the Organizer in other cases expressly indicated in separate regulations.

19. The rules for withdrawing from a distance contract are regulated by the Consumer Rights Act.

20. The content of the Regulations is available on the E-shop website in the "Other regulations" tab.

21. The Regulations are valid from 13 February 2026, from 12:00 noon, to 2 March, 12:00 noon.

22. The Organizer reserves the right to amend the Regulations by adding annexes identified by a sequential number and date. However, any amendments to the Regulations will not adversely affect the terms of participation in the Promotion, nor will they infringe upon the acquired rights of Participants. The Organizer undertakes to provide notice of any amendments in a timely manner before they take effect, so that Participants can become familiar with them.

23. The duration of the Promotion is specified in the Terms and Conditions, but is subject to change, including for reasons attributable to the Organizer. The Organizer reserves the right to cancel the Promotion without providing a reason.

23. The amended Terms and Conditions are effective from the date specified therein, but no earlier than the date of their publication in the form appropriate for the publication of these Terms and Conditions.

24. Complaints and claims related to the Promotion may be sent to: bok@fasklep.pl.

25. A complaint or claim should include: the Client's name and surname, correspondence address (or e-mail address), and a description of the circumstances constituting the basis for the complaint or claim.
26. Pursuant to Article 13 paragraphs 1 and 2 of the General Data Protection Regulation of 27 April 2016, the Organizer hereby informs that the Controller of personal data disclosed in connection with filing a complaint or claim (hereinafter referred to as "Personal Data") is Fitness Authority® Sp.

27. Personal data will be processed solely for the purpose of considering, including responding to, complaints/claims, pursuant to Article 6(1)(f) (legitimate interest of the controller).

28. Persons filing complaints have the right to access, rectify, delete, restrict, transfer, and object to their personal data. These rights can be exercised by sending an email to bok@fasklep.pl.

29. If it is found that the processing of personal data violates the provisions of the General Data Protection Regulation, the above-mentioned persons have the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO).

30. Providing personal data including name, surname and correspondence address is voluntary, but necessary to enable the complaint/claim to be considered.

31. The data controller will not make automated decisions based on the personal data provided. Personal data will not be transferred to third countries.

32. Personal data may be made available to persons who perform activities related to sales and running the E-shop on behalf of the Organizer.

33. Personal data will be processed for the duration of the complaint procedure and may also be processed for the purposes of establishing, pursuing or defending against claims during the limitation period for such claims.

35. Complaints and claims will be reviewed within 14 days of receipt by the Organizer. Participants will be notified of the outcome in the manner they choose. If no form is specified, contact will be made via email or in writing, at the Organizer's discretion. The complaints procedure adopted by the Promotion Organizer does not in any way violate the rights granted to Promotion Participants under generally applicable law, including the right to pursue claims through court proceedings.

36. Making a purchase in the E-Shop during the Promotion constitutes acceptance of the Regulations.
